Acceptable Use Policy

This Acceptable Use Policy (“Policy”) governs your use of any services provided by OTee, including but not limited to OTee’s software-as-a-service (SaaS) platform, websites, and APIs (collectively, the “Services”). This Policy is designed to protect the integrity of the Services, safeguard user data, and set out the standards of conduct required of all users.
By accessing or using the Services, you agree to comply with this Policy. OTee may modify this Policy from time to time; please check this page regularly for updates. Your continued use of the Services after any modifications constitute acceptance of those changes.
1. Compliance with Laws and Regulations
1.1 Legal Compliance
You are responsible for using the Services in compliance with all applicable laws, regulations, and industry standards. This includes, without limitation:

Export control and sanctions laws, such as restrictions on the use of the Services in or on behalf of sanctioned countries or individuals.

Data privacy laws and regulations (e.g., GDPR, CCPA, HIPAA, COPPA, etc.) applicable in your jurisdiction.

1.2 Prohibited Use in Sanctioned Jurisdictions
You will not use the Services in any manner that would violate applicable sanctions laws or cause OTee to violate such laws. This includes attempting to access or use the Services from a sanctioned jurisdiction or on behalf of a sanctioned person, entity, or government.
2. Conduct Restrictions
While using the Services, you may not:
2.1 Security and Service Integrity

Damage, disable, interfere with, or circumvent any aspect of the Services.

Interfere with anyone else’s use or enjoyment of the Services.

Attempt to test, penetrate, or scan the Services for security vulnerabilities or limitations, except as expressly authorized in a separate written agreement with OTee.

Use the Services in a manner intended to avoid incurring fees owed (e.g., suppressing user counts to evade billing).

Act in bad faith or in a manner that negatively reflects on OTee or the Services.
2.2 Impersonation and Deception

Impersonate any person or entity, or misrepresent your affiliation with a person or entity.

Use the Services to compete with OTee by copying or replicating any ideas, features, functions, or graphics of the Services.
2.3 Unauthorized Communications

Distribute or send unsolicited or unwanted communications (“spam”).

Scrape, data mine, or access OTee or OTee content (including third-party content made available through OTee) programmatically, except as explicitly permitted by publicly available OTee APIs.
2.4 Malicious or High-Risk Activities

Use the Services for activities where use or failure of the Services could lead to death, personal injury, or severe property or environmental damage.

Modify or use anything that modifies OTee’s code or code execution without OTee’s express written consent.
3. Content Restrictions
You may not upload, store, publish, share, or distribute via the Services any content that:
3.1 Fraudulent or Deceptive

Is fraudulent, false, misleading, or deceptive.
3.2 Obscene or Offensive

Is defamatory, obscene, pornographic, vulgar, or offensive.

Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.

Is violent or threatening, or promotes violence or actions that are threatening to any person or entity.
3.3 Illegal or Harmful

Promotes illegal or harmful activities or substances.

Contains or distributes malicious or destructive software (e.g., viruses, worms, Trojan horses, spyware, dishonest adware, scareware, crimeware).

Violates the rights of others, including data privacy, confidentiality, and/or intellectual property rights (e.g., using stolen content).

Solicits conduct that is illegal under laws applicable to you or OTee.
3.4 Sensitive and Regulated Data
You must not upload or share any data or content subject to special legal or regulatory protections unless you have first ensured that you and OTee are in compliance with all applicable laws governing such data (and that OTee has explicitly agreed in writing to support such data). This includes, but is not limited to:

Sensitive Data as defined under the GDPR (e.g., race, religion, political opinions, health, genetics, or sexual orientation).

Protected Health Information as defined under HIPAA or similar healthcare data protection laws.

Financial Information, including credit or debit card numbers or financial account information.
-
Government Identifiers such as social security numbers or taxpayer IDs.
-
Data about Minors protected by laws like COPPA, unless expressly permitted in writing by OTee.
4. User Data and Privacy
4.1 Data Responsibility

You acknowledge and agree that you are solely responsible for all data, content, and information that you upload, store, or process using the Services (“User Data”).

You represent and warrant that you have obtained all necessary consents and authorizations to collect, use, and share any User Data in compliance with applicable laws and regulations.
4.2 Data Processing and Security

OTee will process User Data in accordance with applicable privacy and data protection laws and the OTee Privacy Policy.

OTee implements appropriate technical and organizational measures to safeguard User Data. However, you understand and agree that no method of transmission or storage is completely secure, and OTee cannot guarantee absolute security.
4.3 Data Retention and Deletion

You are responsible for complying with any legal obligations regarding recordkeeping and data retention.

Upon account termination or expiration, OTee will follow its data deletion and retention policies, unless otherwise required by law or agreed upon in writing.
5. Intellectual Property
5.1 OTee’s Intellectual Property

All rights, title, and interest in and to the Services (including all related software, design, text, images, trademarks, and logos) are and will remain the exclusive property of OTee or its licensors.

You may not copy, modify, or create derivative works of any part of the Services unless expressly authorized by OTee in writing.
5.2 Your Intellectual Property

You retain all rights and ownership in your User Data.

By uploading or submitting User Data through the Services, you grant OTee a worldwide, non-exclusive, royalty-free license to use, store, process, transmit, and display the User Data solely as necessary to provide the Services in accordance with this Policy and any applicable agreement between you and OTee.
6. Enforcement and Remedies
6.1 Violation of this Policy
If you violate this Policy (or encourage, allow, or assist anyone else to do so), OTee may take any action it considers necessary to protect OTee, its users, and third parties. This may include, without limitation:

Quarantining, blocking, or deleting data stored on the Services.

Removing any of your content.

Suspending or terminating your access to the Services.

Pursuing any other remedies available at law or in equity.
6.2 No Refunds or Credits
You will not be entitled to any credit or other compensation for any interruption of the Services resulting from your violation of this Policy.

7. Termination
OTee reserves the right to suspend or terminate your access to the Services or remove or disable any content or data that OTee in its sole discretion believes violates this Policy, without notice and liability of any kind.

OTee may modify this Policy from time to time. If OTee makes material changes to the Policy, it will post the revised Policy on the OTee website or otherwise notify you. Your continued use of the Services after any changes become effective will constitute acceptance of the revised Policy.
